These Terms and Conditions govern all photography services provided by Michael Roses Photography ("we," "us," "our"). By booking a session, you ("the Client") agree to these terms in full. Please read them carefully before confirming your booking.

1. Booking & Deposit

1.1 Session Confirmation

All sessions are confirmed only upon receipt of a signed agreement and a non-refundable deposit. No date is held without both items completed.

1.2 Deposit Amount

  • Portrait, Model Portfolio & Editorial Sessions: A 50% deposit of the total session fee is required to secure your booking.

  • Commercial & Brand Campaigns: Deposit terms are outlined in your custom project proposal and may vary based on project scope.

1.3 Payment of Balance

The remaining balance is due:

  • For sessions under $2,000 AUD: Full balance due 7 days prior to the scheduled shoot date.

  • For sessions over $2,000 AUD and commercial projects: Balance due according to the payment schedule outlined in your project proposal, typically 50% before shoot, 50% upon delivery.

1.4 Late Payment

If the balance is not received by the due date, the session may be rescheduled or cancelled at our discretion, with the deposit forfeited.

1.5 Payment Methods

We accept bank transfer, credit card, and PayPal. All fees are payable in Australian Dollars (AUD) unless otherwise agreed in writing.

2. Cancellation & Rescheduling

2.1 Cancellation by Client

  • More than 14 days before the session: Deposit is forfeited. No refund issued.

  • 7–14 days before the session: 50% of the total session fee is forfeited.

  • Less than 7 days before the session: 100% of the total session fee is forfeited.

  • No-show: 100% of the total session fee is forfeited, and no rescheduling is offered.

2.2 Rescheduling by Client

  • More than 14 days before the session: One complimentary reschedule permitted. Subsequent reschedules incur a $150 AUD fee.

  • 7–14 days before the session: Rescheduling permitted with a $150 AUD fee.

  • Less than 7 days before the session: Rescheduling is treated as a cancellation (Section 2.1 applies), and a new booking requires full payment.

2.3 Cancellation by Photographer

In the unlikely event that we must cancel due to illness, emergency, or circumstances beyond our control, the Client will be offered:

  • A full reschedule at the earliest mutually convenient date, or

  • A full refund of all monies paid, including the deposit.

We are not liable for any additional costs incurred by the Client (travel, accommodation, styling, etc.) in the event of our cancellation.

2.4 Force Majeure

Neither party is liable for failure to perform due to circumstances beyond reasonable control, including but not limited to: natural disasters, severe weather, pandemic, government restrictions, or equipment failure. In such cases, we will work in good faith to reschedule.

3. Image Copyright & Usage Rights

3.1 Copyright Ownership

All images created by Michael Roses Photography remain the exclusive copyright property of Michael Roses Photography. This is non-negotiable and protected under Australian and international copyright law.

3.2 Client Usage Rights

Upon full payment, the Client is granted a limited, non-exclusive, non-transferable licence to use the final delivered images for the purposes agreed in the booking confirmation:

  • Model Portfolio & Portrait Clients: Personal portfolio, self-promotion, social media, and agency submissions.

  • Commercial & Brand Clients: As specified in the commercial usage agreement — typically for agreed campaign duration, channels, and territories.

3.3 Prohibited Uses

Unless expressly agreed in writing, the Client may NOT:

  • Sell, sublicense, or transfer images to third parties.

  • Use images for purposes outside the agreed scope.

  • Remove, alter, or crop watermarks or credit lines.

  • Apply filters, heavy editing, or alterations that misrepresent the original work.

  • Use images in defamatory, unlawful, or misleading contexts.

3.4 Photographer's Right to Use Images

We retain the right to use all images for:

  • Portfolio, website, and social media promotion.

  • Photography competitions and awards.

  • Industry publications and educational purposes.

  • Marketing and advertising of our services.

Exceptions: If a Client requires confidentiality or exclusivity (e.g., unreleased campaigns, private portraits), this must be agreed in writing before the shoot and may incur additional fees.

3.5 Raw Files

Raw, unedited, or unretouched files are not provided to the Client under any circumstances. All delivered images are professionally edited and represent the final creative vision.

3.6 Image Archival

We archive delivered images for 12 months from the delivery date. After this period, images may be deleted. If you require additional files or re-edits after 12 months, new fees may apply.

4. Travel Fees

4.1 Included Travel

Complimentary travel is included for all sessions within 30km of Brisbane CBD.

4.2 Travel Fees — South East Queensland

For locations beyond 30km from Brisbane CBD, travel fees apply as follows:

Gold Coast: $150 AUD

Sunshine Coast: $150 AUD

Byron Bay: $200 AUD

These fees cover fuel, vehicle wear, and travel time. They are added to your session total and due with your balance payment.

4.3 Travel Fees — Australia-Wide

For shoots outside South East Queensland (interstate or regional Australia), travel fees are calculated as follows:

  • Airfare: Economy return flights from Brisbane

  • Accommodation: 1–2 nights standard hotel accommodation (as required by shoot schedule)

  • Ground transport: Car hire or transfers at destination

  • Per diem: $100 AUD per day for meals and incidentals

  • Travel day rate: 50% of standard day rate for each full travel day

A detailed travel estimate is provided in your project proposal and must be approved before booking confirmation. Travel fees are due 14 days before departure to secure flights and accommodation.

4.4 International Travel

For international assignments, travel fees are quoted on a project basis and include:

  • Return airfare (economy or business class as agreed)

  • Accommodation (standard or as specified by Client)

  • Ground transport and per diem

  • Visa fees and travel insurance

  • Travel day rates as applicable

International travel requires 30 days advance notice and full travel fee payment 21 days before departure.

4.5 Travel Changes & Cancellations

If the Client changes the shoot location after booking, new travel fees apply based on the revised location. If the Client cancels after travel has been booked (flights, accommodation), non-refundable travel costs are the Client's responsibility and will be deducted from any refund or invoiced separately.

5. Session Conduct & Deliverables

5.1 Session Duration

The session duration begins at the agreed start time. Late arrivals reduce available shooting time. We are not obligated to extend the session beyond the booked duration.

5.2 Deliverables

The number of final edited images is specified in your booking confirmation:

  • Model Portfolio Sessions: 8–12 edited images.

  • Editorial Sessions: 5 images per look (flexible by agreement).

  • Commercial Projects: As specified in the project proposal.

5.3 Image Selection

For most sessions, the Client selects final images from a proof gallery within 14 days of delivery. If no selection is made, we will select images at our discretion for final delivery.

5.4 Turnaround Time

Standard turnaround is 2–4 weeks from final image selection or shoot date (whichever is later). Rush delivery is available by arrangement and may incur additional fees.

5.5 Revisions

We include one round of minor revisions per image (colour, contrast, minor retouching adjustments). Extensive re-editing or re-shoot requests are treated as new work and billed accordingly.

6. Client Responsibilities

6.1 Preparation

The Client is responsible for:

  • Arriving on time and prepared.

  • Bringing agreed wardrobe, props, or styling items.

  • Ensuring hair and makeup are complete unless booked through our team.

  • Communicating any special requirements, allergies, or accessibility needs before the shoot.

6.2 Talent & Minors

If the Client is booking on behalf of a model or subject:

  • The booker warrants they have authority to agree to these terms.

  • For subjects under 18, a parent or legal guardian must sign the agreement and be present during the session.

6.3 Behaviour

We reserve the right to terminate a session if the Client, model, or accompanying parties behave in a manner that is unsafe, disrespectful, or disruptive. No refund will be issued in such cases.

7. Liability & Indemnity

7.1 Limitation of Liability

Our total liability for any claim arising from our services is limited to the total amount paid by the Client for the specific session. We are not liable for indirect, consequential, or incidental damages.

7.2 Indemnity

The Client agrees to indemnify and hold harmless Michael Roses Photography against any claims, damages, or expenses arising from the Client's use of the images outside the agreed scope or in violation of these terms.

8. Dispute Resolution

Any dispute arising from these terms will first be addressed through good-faith negotiation. If unresolved, disputes will be mediated in accordance with the laws of Queensland, Australia, and the courts of Brisbane shall have exclusive jurisdiction.

9. Amendments

We reserve the right to update these Terms and Conditions at any time. The version in effect at the time of your booking applies to your session.

10. Agreement

By paying your deposit and confirming your booking, you acknowledge that you have read, understood, and agree to these Terms and Conditions in full.
